Collections

Our firm's collection practice provides a wide variety of services to individuals and businesses. From promissory notes, accounts, secured transactions and other claims, our firm provides a complete array of services to creditors. We do both commercial as well as consumer debt collection.

The collection of debts is an art unto itself. Generally, it is quite easy to obtain a judgment against a Debtor; it is another thing to be able to collect on the judgment once obtained for the benefit of a Creditor. Ultimate profitable collection of a debt depends on a multitude of factors, including:

  1. The location of assets of the Debtor.
  2. The identification of potential asset exemptions available to the Debtor.
  3. The liquidity of the asset chosen to be levied.
  4. The cost of levying on the asset, including levy fees and storage.
  5. The potential of a bankruptcy filing by the Debtor.
  6. The potential of violating the Fair Debt Collection Practices Act.

All these factors must be weighed in order to afford the Creditor an opportunity to go forward with collection of a debt and possible levy on the assets of a Debtor.

We make an effort to ascertain all assets listed in the public records, and by any other means available to us. While we may make a recommendation to file a lawsuit to collect a just debt, we will not necessarily make the recommendation to continue further collection efforts after obtaining judgment against a Debtor, when it is obvious that a Debtor has no assets.

During the litigation of a collection matter, we advise our client-creditor of all potential problems with the claim and apprise our client of the current status of the claim as it progresses, so as to keep the client completely informed.
